What are Cottage Food Laws? 

They are laws that allow people to make certain types of food right from your home kitchen, and then legally sell them within certain venues.

Since 2007, many states started adopting Cottage Food Laws (CFL) to help give people living in their states an easier way to make some extra money. This offers people the opportunity to bring in an additional revenue while helping their local communities.  Home cooks are able to do something they love, making their own hours, working in their own home kitchens.  Sound too easy?  Let me explain.

Yes, there are regulations, but the States have been making it easier to have a small business from your kitchen.  Home Cooks can sell certain “non-hazardous” food products made at home without all the burdensome regulations.  Cottage Food Laws allow people to sell to the public low moisture foods like breads and cookies as well as high acid food products like jams and jellies.  Most states now have these cottage food laws now that don’t require a licensed kitchen.

For several years, movements have been underway throughout the country to promote and provide locally made food.  As these small home businesses  started cropping up around the country, the term  “cottage food” was a catchy phrase used to describe these laws and the “Cottage Food Operations”.  States have recently been improving their Cottage Food Laws offering a legal way for the home food business to exist.   These rules might also be called Home-Food Processing Rules or Baker’s Bills.

All States Cottage Food Laws Include

Of course, Cottage Food Laws differ from state to state.  While each state has a different variation, all the Cottage Food Laws contain the following four basic rules covering each of the issues described below:

  1. Identify what type of product you can sell
  2. Explain where your products can be sold
  3. Limits the Dollar Amount before you need to upgrade your business to a licensed food production facility
